Conditions of Entry

To be read in conjunction with the Terms and Conditions and COVID-19 Policy.

By entering the Hanmer Springs Thermal Pools and Spa premises (Pools), you confirm that you have read and accept these Conditions of Entry and that you agree to comply with them:

  • 1. General

    1. General

    1.1 Conditions of entry are subject to Government and other regulatory legislation, health orders, directions and mandates that require compliance at law.

    1.2 Children under 8 years of age will not be admitted unless accompanied by an adult.

    1.3 If you intend to swim or use the private thermal pools, sauna or steam facilities, you must shower before entering the water. If you have had diarrhea within the last 48 hours, you must not enter the water. You must not undertake any exfoliation when bathing in the Pools.  

    1.4 No smoking or vaping is permitted.

    1.5 No alcohol, drugs, glassware or commercially prepared food or beverages may be brought into the Pools. You may be refused entry or requested to leave the Pools if we reasonably believe that you are adversely affected by drugs or alcohol.

    1.6 No food or drinks can be consumed in or over the water of the pools.

    1.7 Baby feeding, including breast feeding, is encouraged and accepted in all areas of the Pools except in or over the water of the pools.

    1.8 Alcohol sold by the onsite café must be consumed in the licensed area only.

    1.9 Appropriate swimwear is required to be worn at the Pools. Fitted leggings and t-shirts are appropriate but streetwear, denim, belts and baggy items are not to be worn in the pools for safety reasons.

    1.10 Frisbees, balls, inflatables or other devices that may risk the safety of yourself or others or impede our staff's ability to keep the pools safe for everyone are not permitted.

    1.11 You must not display anything that contains obscene, foul, profane, illegal or unacceptable language, photos, images, symbols or phrases.

    1.12 Aqua Therapy pools are accessible to those aged 16 years and older.

    1.13 Any photos, videos or sound recordings taken by you must be for personal use only. Subject to our written consent, any use, reuse or production for commercial purposes is prohibited. You must not use image recording devices in any changing room or bathroom facility.

    1.14 Diving is allowed in the deep end of the main lap pool only.

    1.16 Please enter all pools with care via the designated steps, beach access and handrail entry / exit points.

    1.17 We recommend keeping all valuables at home or in the lockers provided to avoid misplacing, losing or leaving them behind. We accept no responsibility for any loss or damage of personal property.

    1.18 Please report all incidents to staff immediately.

    Whilst we take all reasonable steps to provide you with a safe and enjoyable facility, by entering the Pools, you accept all risk of loss, damage or personal injury or illness whether caused by any person's negligence (including ours) or otherwise.

    We reserve the right to close individual pools or activities due to weather, maintenance or health and safety requirements.

  • 2. Supervision of children

    2.1 Children under the age of 8 must be actively supervised by a responsible caregiver aged 16 years or over. 'Actively supervised' means watching your children at all time and being within a close distance to provide immediate help if required. 

    2.2 Children under 5 years of age must be within arm’s reach of a caregiver aged 16 years or over at all times.

    2.3 Our lifeguards and/or other team members do not supervise children.

    2.4 The following steps will be followed in the event of a child being left alone / inadequately supervised:

    • The child will be removed from the water until their parent/caregiver is located, or if needed, phoned if they are not at the Pools.
    • The child will be handed over to the person nominated by the Team Leader until parent/caregiver is located.
    • If parent/caregiver cannot be contacted and a reasonable amount of time has passed the Police should be contacted by the Team Leader.
    • In all circumstances, the child will stay out of water until the child's responsible supervisor is located.
    • Upon contacting the parent/caregiver, they are to be verbally advised of the 'Pool Alone Policy' and the requirement upon them as caregiver.
  • 3. School / Group supervision additional terms

    If you are a school or group that visit the Pools, prior to your arrival you will be provided with a specific supervision policy you need to plan for and adhere to.  All school groups attending the Pools must attend a school group safety talk from a lifeguard.  For groups that arrive without booking, a copy of the policy will be given to you and your responsibilities explained.  You acknowledge and accept you must comply by the additional school / group additional terms if provided or read to you.

  • 4. Hydroslide, Conical Thrill and SuperBowl Terms

    4. Hydroslide terms

    • Riders must be 5 years old and over to ride the hydroslides.

    4.1 Conical Thrill and Super Bowl additional terms

    • Riders must be 5 years of age or older.
    • Maximum of two riders to a raft.
    • Children under 8 must be accompanied by an adult (over 16 years old).
    • Maximum combined weight 180kg, minimum combined weight 45kg for double rafts.
    • Eyewear is not permitted to be worn.
    • Only one inflatable tube allowed on the ride at a time.
    • All riders must follow the instructions of the lifeguards.
    • Caution - for safety reasons pregnant women and persons with heart conditions or back trouble should not ride this slide.

    If you do not comply with the applicable terms or our reasonable directions you will not be permitted to ride.

  • 1. Application of these terms

    1.1 By using our website, https://hanmersprings.co.nz (Website), purchasing goods and services from us (Products) and/or entering the Hanmer Springs Thermal Pools and Spa premises (Pools), you confirm that you accept these terms and that you agree to comply with them.

    1.2 If you purchase a Product for another person, you are responsible for ensuring that person is aware of these terms and that they comply with them. If you purchase a Product for a minor, you are responsible for the Product and are the authorised representative for the minor.

    1.3 These terms will be read together with additional terms referred to herein and any of our other policies on our Website or displayed or notified to you at the Pools and apply to the exclusion of all other terms.

    1.4 We may make changes to these terms and any additional terms referred to herein by updating them on our Website from time to time or displaying or notifying them to you at the Pools, and you will be bound by these terms when you use our Website, purchase our Products and/or enter the Pools.

     

     

  • 2. Your obligations

    2.1 Responsibility. There are inherent risks in the participation in or at the Pools.  You, by entering the Pools, accept the inherent risks of personal injury, accident, illness or personal property loss. You must act in a responsible manner while at the Pools.  Adults and caregivers are solely responsible for persons under their supervision.  You must act with good judgement and consideration both for yourself and others, and refrain from behaviour which could affect your safety or the safety of others. Physical restrictions may apply on the waterslide or other facilities for safety or operational reasons, please refer to displayed signage.  You are responsible for your own personal property and vehicle while at the Pools.

    2.2 Conditions of Entry. As a condition of access to the Pools, you agree to comply with the Conditions of Entry and any other terms and conditions displayed at the entry to the Pools.

    2.3 COVID-19. You agree to comply with our COVID-19 Policy, including mandated public health measures applicable to facilities such as ours at the time of your visit to the Pools.  You are not entitled to any claim for expenses, losses or other relief due to you being removed from and/or denied access to the Pools due to failing to comply with our COVID-19 Policy.

    2.4 Reasonable directions. You must obey all reasonable and lawful written and verbal instructions, directions and warnings given by us and our staff, including lifeguards, without objection.  You must use, as instructed, all safety equipment and/or comply with all directions provided to you when participating in any waterslide.

    2.5 Information you provide to us.  You must provide true, current and complete information in your dealings with us (including when purchasing our Products and setting up a membership login through the website and/or entering the Pools).  We take no responsibility for any incorrect or inaccurate information provided by you.

     

     

  • 3. Privacy

    We collect your personal information to allow us to supply you with Products, and we collect and use your information in accordance with the terms of our Privacy Policy.  By placing an order for Products or making a booking through our Website and providing us with such information, you consent to the collection of your personal information for the purposes of fulfilling your order and/or booking and for the other reasons set out in our Privacy Policy.

  • 4. Refusal of entry, cancellation and closure

    4.1 You may be refused entry or requested to leave the Pools (at our discretion) if you are in breach of any of these terms, fail to properly supervise persons under your care, are objectionable to other customers or us, or are, for any reason, disturbing, causing discomfort or threatening the safety or security of another patron or us (including any of our staff).

    4.2 We reserve the right to inspect your bags or other goods in your possession immediately upon request for reasonable security purposes.

    4.3 We may cancel or suspend any Product you have purchased or refuse entry at our sole discretion, including where we reasonably believe the same has been obtained in an unlawful or improper manner or in breach of these terms.

    4.4 We may close the Pools on a permanent or temporary basis at any time (at our discretion) without notice including due to inclement weather, safety, refurbishment, maintenance, Acts of God or government mandated lockdown or similar restriction. We may impose restrictions or limitations on access to pools or other areas at the Pools at any time. 

  • 5. Product purchase and booking terms

    5.1 The price of the Products are shown in New Zealand dollars and are inclusive of GST.  We endeavor to ensure that all prices on our Website are consistent with the prices offered at the Pools however in some cases prices online and onsite may differ (including, for example, where there are special "online only" promotions).  We reserve the right to amend our pricing at any time. 

    5.2 Delivery delays. Where the supply, postage or delivery of the Products have been delayed by an event outside of our control (including a 'force majeure event'), we are not responsible for the delays caused by such events.  

    5.3 Gift vouchers. Gift vouchers can be used for the purchase of Products that have not yet been booked and do not have confirmed reservations.  Gift vouchers cannot be used in conjunction with any special promotion. Gift vouchers are valid for 12 months from the date of purchase and cannot be redeemed after expiry date except in exceptional circumstances and at our discretion.  Vouchers are valid only and up to the date shown on the voucher.  For 'Open Dated Travel Packages' the reservation and redemption of any gift voucher must be made before the voucher expiry date but the actual date of booking can extend beyond the voucher expiry date.  We are not responsible if a gift voucher is lost, altered, stolen, destroyed or used without permission. 

    5.4 AA membership discount. AA Members and their guests are entitled to 20% off any single entry ticket to the pools.  This offer is available to current AA Members and their guests when a valid AA membership card is presented at the time of purchase of the ticket(s).  If a Product has been purchased without the AA membership discount, the Product will not be discounted and the Product is not eligible to be refunded or credited after payment has been processed.  The discount afforded by the AA Membership cannot be used in conjunction with any other offer.   The forementioned AA Membership discount is not applicable to 2-day passes, return passes, private pools and saunas, spa treatments and products, lockers and café purchases.  The AA Membership discount will not be applied and no refund will be available if you present an AA membership card once payment has been processed.

    5.5 Additional Product terms:

    5.5.1 All tickets. Tickets are valid for 12 months from the date of purchase unless otherwise stated or at our discretion and are valid on the day of use only.  All tickets must be used in accordance with any time, date and/or special conditions indicated at the time of purchase or on the ticket and in accordance with these terms.  Entry tickets do not include access to facilities or experiences that are not explicitly included in the entry price.  A 2-day pass entitles you to single entry to the Pools for a period of 2 consecutive days from the first day of entry.  Lost or stolen tickets cannot be replaced.

    5.5.2 Annual Swim Pass. The Annual Swim Pass (Pass) entitles the named holder or family flexible entry to the Pools during their operating days for 12 months from the date of purchase. A family pass consists of two adults and up to four dependent children aged 5 – 15 at the same address (children under 5 receive free admission).  You acknowledge that a current photograph of the named holder or individual family members will be taken and stored digitally by us for verification of identity purposes.  A Pass is not transferrable and will be cancelled without refund if used by anyone else.  A Pass entitles the named holder or family to use of the outdoor complex including slides and does not include entry to private thermal pools or sauna or steam suites.  We reserve the right to suspend, revoke entirely or refuse entry under a Pass at our discretion, including if the named holder or family do not meet the requirements set out in our Covid Policy.   By purchasing a Pass online, you agree to be contacted by us with information regarding the Pass or any associated benefits or other special offers and updates from time to time.  You may unsubscribe at any time by contacting us or using the unsubscribe option on the received emails. 

    5.5.3 PoolsPlus loyalty card and membership. The PoolsPlus loyalty programme (PoolsPlus) offers you the opportunity to receive discounts on selected Products as specified (in our discretion) on our website or at the Pools.  The discounts afforded by PoolsPlus cannot be used in conjunction with any other offer.  Completing an application for membership in PoolsPlus and/or use of a loyalty card is deemed acceptance of these terms.  Applications for membership and booking of entry tickets may be completed at the Pools or online (and you must apply the discount at the checkout).  If a Product has been purchased without the PoolsPlus membership discount, the Product will not be discounted and the Product is not eligible to be refunded or credited after payment has been processed. The terms applicable to entry tickets as set out in these terms also apply to tickets purchased using the PoolsPlus loyalty card.  Applications may be made by any person who is a New Zealand resident and proof of residency may be required.  Membership on a single card is available for two adults and up to four dependent children aged 5-15.  Memberships and/or your loyalty card are not transferrable and will be cancelled without refund if used by anyone else. You acknowledge that a current photograph of the named card holder or individual family members will be taken and stored digitally by us for verification of identity purposes.  You should present your card on all purchases of Products to enable us to provide you with discounts, or alternatively you will need to provide us with your phone number or email address.  By joining PoolsPlus, you agree to be contacted by us with information regarding PoolsPlus or any associated benefits or other special offers and updates from time to time.  As our communication of PoolsPlus offers will solely be via email, you must remain subscribed to the PoolsPlus database to be eligible for exclusive discounts, rewards and offers.

    5.5.4 Packages and Bookings

    5.4.4.1.     Cancellation.  Bookings will be fully refunded if cancelled up to 48 hours prior to the time of your scheduled visit.  No refunds will be given for amendments or cancellations within 48 hours of your scheduled visit except in exceptional circumstances and at our discretion.  Bookings cancelled within 48 hours of your scheduled visit will incur payment in full if the booking cannot be resold.  Gift Vouchers cannot be refunded once booked, instead a new date needs to be given at time of cancellation of the Package.

    5.4.4.2.      Age.  Unless accompanied by a parent or guardian, to make a booking you must be aged over 18 years old.

    5.4.4.3.      Liability.  By making a booking, you accept liability for all loss and damage caused during the booking period.  Where you are liable for loss or damage, we may charge fees associated with repairing or dealing with the loss or damage to the credit card used as security against your booking. 

    5.4.4.4.      Third party suppliers.  You acknowledge that other third party suppliers provide goods and services as part of a package purchased through us or Hurunui i-SITE.  We accept no responsibility for the goods and services or information provided by third parties and, in particular, do not guarantee or warrant the accuracy of or the fitness for any particular purpose of, or merchantability of, any third party information, goods or service available from, or referred to, on our Website or offered as part of a package with our Products.  Any dealing you have with a third party provider, including any purchases, refund requests and complaints, is solely between you and that third party.  Your dealings are with the third party supplier directly and not with us as agent for the supplier.  We take reasonable care to ensure that third party providers receive your requested booking time/date, but we are not liable for any direct or indirect loss or damage you or anybody else might suffer by dealing with a third party. 

  • 6. Refunds

    6.1 Non-redeemable. All Products and gift vouchers (whether purchased directly from us or from a third party supplier) are not redeemable for cash, are non-refundable (subject to our discretion), non-exchangeable and cannot be on-sold.  You are not entitled to a refund of Products where you fail to comply with these terms including, to the extent permitted by law, no refund will be given if you fail to provide suitable evidence of vaccination against COVID-19 or otherwise fail to comply with our Covid Policy. 

    6.2 Change of mind. Refunds on Products will not be granted due to change of mind.

    6.3 Consumer laws: Nothing in these terms will limit or affect your rights as a consumer under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986 (FTA) and you have rights under both the CGA and FTA as a consumer.

  • 7. Use of the website

    7.1 Changes, suspension and withdrawal. We may update and change our Website from time to time.  We do not guarantee that our Website and any content on it will always be available, error free or be uninterrupted.  We may suspend or withdraw or restrict the availability of all or any part of our Website at any time without notice.

    7.2 Membership login. You must keep your membership login details secure and not permit any other person to use your login details or disclose them to any third party.  You must immediately notify us if you become aware of any disclosure or unauthorised use of your membership login details.

    7.3 No interference. You must not disrupt, overwhelm, attack, modify or interfere with the Website or its associated software, hardware and/or servers in any way or attempt to impede or interfere with others' use of the Website.   You will not damage the operation of our Website, including by way of introducing a virus, corrupt file or otherwise.  Further, if you wish to link to any part of our Website in your own materials, you must get prior written consent from us.  We reserve the right to suspend your use of our Website if we reasonably believe that you have breached these terms or the law.

    7.4 Intellectual property. Content on our Website including graphics, logos, trade marks, product names, designs, text and information is intellectual property which is either owned or licensed by us and is protected by New Zealand and international law including the Copyright Act 1994.  Our Website is for your personal use and except to the extent permitted by law, you may not copy, alter, reproduce and/or utilise content or parts of the content on our Website, including for data mining, without our prior written permission or, in the case of third party material, from the owner of the intellectual property in that material.

    7.5 No warranties. While we have endeavored to ensure that the information we have provided on our Website is error free, it is provided "as is" and "as available" and without warranties of any kind either express or implied. Except to the extent permitted by law, we do not make any warranties or representations as to the accuracy of information, content, materials or Products on our Website nor that our Website is error free, free of viruses or other harmful components.  You accept sole and full risk associated with the use of this Website and the use of or reliance on any information contained within this Website. 

    7.6 Third party links. We are not responsible for any third party content or links posted on our Website as these are provided for convenience only and we do not monitor the content on those links.

  • 8. Limitation of liability

    Limitation of liability. To the maximum extent permitted by law, we will not be liable to you or any third party (whether for breach of contract, tort (including negligence) equity, for breach of statute or regulation or on any other basis) under or in connection with these terms for any indirect, consequential or special loss, damage, injury or illness.  To the maximum extent permitted by law and only to the extent the foregoing does not apply, our total liability to you under or in connection with these terms must not exceed NZD100.  Nothing in these terms excludes the provisions of or limits our liability under the CGA or the FTA.

  • 9. General

    9.1 Who we are. References to 'we', 'us' and 'our' in these terms means Hanmer Springs Thermal Pools and Spa which owns and operates the Website at Hanmersprings.co.nz and the Pools.  If you have any questions about these Terms, please contact us at info@hanmersprings.co.nz.

    9.2 Waiver. No waiver of a right or remedy under these terms or at law will be effective unless that waiver is in writing. Failure by us to insist on strict performance of any term or conditions in these terms should not be deemed to be a waiver of any rights we might have and must not be deemed a waiver of any subsequent breach of any term in these Terms. 

    9.3 Assignment. We may assign or transfer our rights and obligations under these terms to someone else, so long as this does not materially affect your rights. You may not assign or transfer your rights under these terms without our permission (which will not be unreasonably withheld).9.4

    9.4 Severability. If any part of these terms is held to be invalid, unenforceable or illegal, then the rest of these terms will continue in full force and effect.

    9.5 Governing law. These terms are governed by the laws of New Zealand and the courts of New Zealand will have exclusive jurisdiction.

COVID-19 Policy

The rules set out in this policy are intended to keep you, your family, the community and our staff and contractors safe from COVID-19. To be read in conjunction with the Conditions of Entry and Terms and Conditions.

  • COVID-19 Policy

    The rules set out in this policy are intended to keep you, your family, the community and our staff and contractors safe from COVID-19. 

    This policy is subject to change at any time, subject to Government directive and/or in our sole discretion. 

    To enter the Pools, you agree to comply with:

    a) all requirements, rules and directives published, mandated and updated by the Government from time to time at covid19.govt.nz; and

    b) all policies and procedures adopted by Hanmer Springs Thermal Pools and Spa in relation to the COVID-19 (or otherwise-named) pandemic, including but not limited to:

    • sanitising your hands;
    • complying with any additional public health measures (including social distancing rules) that are in place at the time of your visit. 

    We also ask that if you are feeling unwell, please do not come to the Pools and stay home instead.

    We reserve the right to make changes to our COVID-19 and other health and safety practices at any time without notice to you.  For example, some parts of the Pools may not be operational due to requirements of our COVID practices or we may have to operate at reduced capacity or hours.
